Showalter Defeats Three Prosecutors in Non-Support Case

Upon a motion by Hendricks County Prosecutor Patricia Baldwin the felony Non-Support charge under I.C. 35-46-1-5(a) against Showalter was z-016 dismiss support case by Judge Steve David on 05 February 2007. The case arose on 03 February 2005 when Boone County Prosecutor Todd Meyer (104 Ulen Drive, Lebanon, IN 46052) accused Showalter of failure to provide ” food, clothing, shelter or medical care ” to his dependent son for 2 1/2 years.

Meyer quickly dropped out of the case when Showalter proclaimed to him that he will expose the illegal activities and corruption going on in the prosecutor’s office and with Boone Circuit court judge, Steve David. Former Clinton County Prosecutor Louis Evans then accepted assignment to the case.

The case was set to go to trial on 22 August 2005 but when Showalter issued subpoenas for prosecutors and a court officer Meyer filed a z-016 quash subpoena todd Petition alleging that his testimony would “embarrass” him. Judge David vacated the trial that day after seeing this flyer that invited the public to attend and see corruption by the court exposed.

At a subsequent pre-trial conference Mr Showalter informed Mr Evans that he didn’t know the law and that he was going to get stomped in court. Evans was successful in using delay tactics to get a trial date of 23 January 2007 set. About a month prior though that Evans, knowing that Showalter would destroy him and the State’s case at trial, withdrew from the case. Prosecutor Baldwin, too afraid to face Showalter in any proceeding, has moved for a dismissal.

Among the many instances of corruption by the Boone Circuit Court Judge is what has become known as the Halloween incident. Boone County Chief Deputy Prosecutor Jeff Edens (1245 John Bart Road, Lebanon, IN 46052) represented Showalters ex-wife, Elica Talbot in a divorce. In an z-180 oct 31, 2001 incident Edens and Talbot allege that Mr Showalter was engaged in activities on Halloween night 2001 that were never substantiated by any evidence in court. It was even alleged that a video tape existed and was in police custody but at a hearing on 30 November 2001 no tape was produced and no officer was able to testify as to the existence of any such tape. A Letter from Garaffolo Halloween says no tape exists.

What is stunning about the document is the date it was filed with the court. Look in the top right corner. Keep in mind that the courthouses closes at 4:00p.m. The bottom right shows that the Clerk of the Courts certified this document as a true and accurate copy. This Halloween incident document was filed after four previous attempts at getting custody of his child taken from him had failed. By working in the prosecutor’s office Jeff Edens knew what to allege to get custody and knew this perjured pleading wouldn’t result in a prosecution because Todd Meyer would support him and not prosecute this crime.

The sudden dismissal of this case may have been brought about by Showalter’s latest two filings. The first was a Notice of Tort Claim against prosecutors Meyer and Evans filed on 30 January 2007. The second was this 06D01-0702-CT-0058 showalter v talbot filed on 01 February 2007 alleging she had provided false statements to the prosecutor for the purpose of having Mr Showalter charged with Non-Support of a Dependent.

Showalter had been in previous contact with federal investigators but had been withholding all evidence pending a trial and questions about the legality of recordings made by the parties. Showalter filed 06C01-0502-FD-0016 motion reinstate 15-02-07 to the State’s Motion to Dismiss. It was, of course, denied by Judge David who never wanted to see this matter go before a jury and the evidence of his corruption and pay-off by Talbot to take custody of their child from Showalter.
